Judgment 1. The petitioner has filed this writ petition for the issuance of a Writ of Mandamus, to direct the third respondent to consider and pass orders on the representation of the petitioner dated 30.11.2012 with regard to fixing of maximum age of 32 as on 1.1.2012 for the post of Assistant, for the Degree holders who hail from Backward Class, Most Backward Class, De-notified Community and SC/ST, in contrary to Rule 149(3) of the Tamil Nadu Co-operative Societies Act, 1983 and Rule 1988 and Government orders. 2. When the matter was taken up for hearing, the petitioner drew the attention of the Court to the Notification dated 13.6.2012 issued by the Tamil Nadu Public Service Commission, wherein it has been mentioned as follows:- “No maximum age limit for SCs, SC (Arunthathiyar), STs, MBCs/DCs, BCs (other than BCMs), BCMs and Destitute Widows of all Castes.” 3. According to the petitioner, as per the above notification dated 13.6.2012, the petitioner had participated unsuccessfully in the written examination and, therefore, she wants to question her non-selection on the ground that age is not a bar. Therefore, prayer is made to grant that liberty to the writ petitioner to raise all the points raised in this writ petition along with liberty to challenge her non-selection on other grounds in accordance with law before the competent forum. 4. In such view of the matter, while recording the said submission of the petitioner, as above, this petition is disposed of granting liberty to the writ petitioner to challenge her non-selection in addition to raising all the grounds as has been raised in this writ petition, if so advised. Consequently, connected miscellaneous petition is closed. However, there shall be no order as to costs.
