JUDGMENT A.M. Sapre, J. Heard Mr. A.M. Barbhuiya, learned counsel for the appellant and Mr. J.I. Borbhuiya, learned Standing Counsel, P.H.E. Department, appearing for the respondents. This is an intra-court appeal filed under Rule 2(3) of Chapter V-A of the Gauhati High Court Rules by the writ petitioner of W.P.(C) No.3364 of 2013 against the order dated 13.12.2013 passed in the aforesaid writ petition by the Single Judge. At the outset Mr. J.I. Borbhuiya, learned counsel appearing for the respondents submits that the case of the appellant was considered with a view to find out whether she can be given any compassionate appointment but it was rejected on 21.12.2011 by the District Level Committee appointed by the State to consider such case on merits. In the light of the statement made by learned counsel for the respondents, we are not inclined to entertain this appeal which arises out of a petition filed by the appellant-writ petitioner and which was dismissed on the ground of delay and laches and where challenge was not to the rejection made by the State in the year 2011. Without, therefore, expressing any opinion on the rejection issue, we dismiss this appeal as having rendered infructuous leaving the appellant to take recourse to any other remedy available in law for challenging her rejection on merits. No cost.
