S.NAGAMUTHU

body2014
Judgment The petitioner had applied for licence for running a bar attached to Shop No.5412 in Madurai District. The petitioner was selected, but, the TASMAC shop could not be opened, due to the filing of a Public Interest Litigation, before this Court. Thereafter, the District Manager, TASMAC Limited, Madurai, by order dated 02.12.2010, in Na.Ka.No.1101/2010/EE has dropped the proceeding for issuance of licence to the petitioner and instead directed him to come and collect the security deposit. 2. I have heard the learned counsel appearing for the petitioner, the learned Standing Counsel appearing for the respondents and perused the records carefully. 3. The bar cannot be run, in view of the objection raised by filing a Public Interest Litigation. Therefore, the District Manager, TASMAC is right for dropping the proceedings. In such view of the matter, I do not find any infirmity in the order passed by the second respondent. 4. In the result, the writ petition fails and the same is dismissed accordingly. Consequently, connected M.P.(md).No.1 of 2010 is also dismissed. No costs.
