Judgment 1. The petitioner is working as Supervisor in TASMAC shop No.4830 at Kanyakumari District. On the allegation that he was selling the liquor at the higher rate of Rs.10/-, he was placed under suspension by the District Manager by his proceedings in Na.Ka.A/724/2012, dated 08.06.2012. Challenging the same, the petitioner is before this Court. 2. While admitting the writ petition, this Court has granted an order of interim stay and on account of the same, the petitioner is still continuing in service. 3. I have heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents. 4. The learned Standing counsel appearing for the respondents would submit that a charge memo has been issued already. 5. In my considered opinion, since the impugned order of suspension was issued in the year 2012 and since no progress has been made in the disciplinary proceedings, the impugned order cannot be prolonged further. 6. The learned Standing counsel for TASMAC would further submit that liberty may be given to the second respondent to complete the disciplinary proceedings. 7. In view of the above, the writ petition is allowed and the impugned order dated 08.06.2012 is set aside, however, with liberty to the second respondent to complete the disciplinary proceedings by following the procedure established by law, as expeditiously as possible. Consequently, connected M.P.(md).Nos.1 & 2 of 2012 are closed. No costs.
