Judgment : 1. This Writ Petition is filed to carry out amendment in the Service Register Book of the petitioner with relation to change of his date of birth from 05.04.1959 to 02.02.1961. 2. It is submitted by the learned counsel for the petitioner that the petitioner joined the service in the year 1982 and his date of birth was given as 05.04.1959 as per the date of birth mentioned in SSLC Certificate and recently the petitioner was able to find out his birth certificate, wherein his date of birth was mentioned as 02.02.1961 and therefore, he has filed the Writ Petition for taking steps to change his date of birth in the Service Register Book from 05.04.1959 to 02.02.1961. 3. The learned Special Government pleader submitted that the contention of the learned counsel for the petitioner cannot be accepted considering Rule 49 of the Tamil Nadu Subordinate Service Rules. 4. Admittedly, the petitioner joined Government Service in the year 1982 as Field Surveyor and after nearly 32 years, he wants to change his date of birth in the Service Register Book on the basis of the Birth Extract issued by the Dharmapuri Municipality. As per Rule 49 of the Tamil Nadu State Subordinate Service Rules, the date of birth can be altered if any representation is made within five years from the date of joining into Service. In this case, attempt is made after 30 years. Hence, this Writ Petition cannot be entertained. 5. Accordingly, the Writ Petition is dismissed. No costs.
