Rajesh, the learned counsel appearing on behalf of the petitioner, Mr.A.K.Baskara Pandian, the learned Special Government Pleader appearing on behalf of the respondents 1 to 3 and 5, as well as Mr.P.Srinivas, the learned counsel appearing for the fourth respondent. 2. This Writ Petition has been filed praying that this Court may be pleased to issue a Writ of Mandamus, forbearing the respondents from evicting the residents of Town Survey Nos.1203/1 and 1203/2 of Palani Village, without following the due process of law. 3. At this stage of the hearing of the writ petition, the learned Special Government Pleader appearing on behalf of the respondents 1 to 3 and 5 had submitted that similar Writ Petitions had been filed before a Division Bench of this Court, in W.P.(MD) Nos.7440 and 7552 of 2009, to restrain the official respondents, from removing the encroachments in Town Survey Nos.1203/1, 1203/2 and 836/1A1 of Palani Village, Dindigul District. The Division Bench had dismissed the said Writ Petitions stating that, the encroachments have been made on a water body and therefore, the residents in the said survey numbers do not have any right to occupy the same. The Special Leave Petition filed by the petitioners, in S.L.P.(C) No.21961 of 2010, had also been dismissed by the Hon'ble Supreme Court, by its order, dated 10.12.2012, stating that the view taken by the High Court is consistent with the law laid down by the Supreme Court holding that no encroachments would be tolerated over the water bodies which constitute a part of the precious natural resources of the nation. 4. In such circumstances, we do not find any cause or reason to grant the reliefs as prayed for by the petitioner, in the present Writ Petition. Accordingly, this Writ Petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
