JUDGMENT Pankaj Mithal,J. Heard Sri P.K. Srivatava, learned counsel for the petitioner and learned Standing counsel for the respondents. 2. Petitioner's application for enhancement of rent under Section 21 (8) of U.P. Act No. 13 of 1972 has been rejected by the courts below on the ground that the premises in dispute was allotted under the old Act in the year 1966 and therefore the petitioner has to apply for enhancement of rent under the old Act. 3. The application for enhancement of rent was filed on 18/27.1.1983 when the present Act had come into force and the old Act stood repealed. Therefore, irrespective of the time of creation of the tenancy or the statute under which the tenancy was created the Act in force would hold the field. 4. The courts below have manifestly erred in law in rejecting the application for enhancement of rent under Section 21 (8) of the Act. 5. Accordingly, impugned orders dated 30.7.2010 and 2.8.2011 are quashed and the writ petition is allowed with the direction to the Rent Control and Eviction Officer to proceed and decide the application of the petitioner for enhancement of rent under Section 21 (8) of the Act in accordance with law as expeditiously as possible preferably within a period of six months from the date of production of the certified copy of this order.
