Judgment : 1. The petitioner seeks for issuance of a Writ of Mandamus to direct the respondents to consider the representation of the petitioner and issue separate patta in his name. 2. Admittedly, the petitioner is a joint pattadhar along with the fourth respondent. As against the issuance of joint patta, the fourth respondent has preferred an appeal and the same is pending before the second respondent. In the interregnum, the petitioner wants separate patta by deleting the name of the fourth respondent. Therefore, both the representation and the appeal petition have to be enquired into by the second respondent. Accordingly, there shall be a direction to the second respondent to consider the representation dated 16.05.2013 for issuance of separate patta to the petitioner along with the appeal petition filed by the fourth respondent. Since the effect of the orders to be passed on the representation and appeal petition will be one and the same, the second respondent, after giving opportunity of personal hearing to both parties, shall pass orders on merits and in accordance with law, within a period of six week from the date of receipt of a copy of this order. 3. The Writ Petition is disposed of, with the above direction. No costs.
