Judgment : 1. The petitioners seek for issuance of a Writ of Mandamus to direct the third respondent to conduct an enquiry in respect of their lands and to consider their representations. 2. According to the petitioners, they are in possession of the property in question for several years and private respondents, without right, title or interest over the property, are attempting to survey the land for which notice has been issued. Therefore, the petitioners immediately submitted representations to the third respondent. Since the representations were not considered, the petitioners have approached this Court. 3. The learned counsel for the seventh and eighth respondents submitted that the land in question belongs to A/M. Subramaniya Swamy Temple. As encroachments have been made and with a view to vacate the same, action has been taken. 4. In the light of the above, this Court is not inclined to go into the disputed question of facts at this juncture. Since the only grievance of the petitioners that their representation have not been considered, there will be a direction to the third respondent to consider the representations of the petitioners on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order. It is made clear that this Court has not gone into the merits of the matter and it has to be decided by the third respondent independently. 5. The Writ Petitions are disposed of with the above directions. No costs. Consequently, the connected miscellaneous petitions are closed.
