JUDGMENT Devendra Kumar Upadhyaya, J. The petitioners had filed a writ petition under Article 32 of the Constitution before the Supreme Court (Writ Petition (Civil) No.794 of 2014). On 2 September, 2014, the writ petition was dismissed as withdrawn with liberty to approach the jurisdictional High Court in the following terms: ?Taken on Board. Learned counsel for the petitioner states, that the petitioner may be permitted to withdraw this petition with liberty to approach the jurisdictional High Court. The writ petition is accordingly dismissed as withdrawn with liberty, as afore-mentioned.? The learned counsel appearing on behalf of the petitioners has stated before the Court that in view of a subsequent order dated 18 September 2014 of the Supreme Court in Hind Charitable Trust Shekhar Hospital vs. Union of India (Writ Petition (Civil) No. 469 of 2014, the petitioners are advised to apply to this Court for withdrawal of the petition since the petitioners intend to move appropriate proceedings before the Supreme Court. In the circumstances, the Court has not been called upon to determine the merits of the issues raised under the present proceedings. The petition is, accordingly, permitted to be withdrawn in terms of the request made before the Court. There shall be no order as to costs.
