Judgment 1. The petitioner has registered his name with the third respondent Employment Exchange for the post of Conductor in the year 1998. He has been periodically renewing his registration. According to the petitioner, in the year 2012, recruitment to the post of Conductor took place in the respondent Corporation based on the sponsorship made by the third respondent. 2. The grievance of the petitioner is that when his juniors were called for interview, his name was not sponsored by the Employment Exchange. Hence, he made a representation to the third respondent to sponsor his name for the post of Conductor. Since the same was not done, the petitioner has come up with the present writ petition. 3. Today, when the matter is taken up, the learned Additional Government Pleader has stated that name of the petitioner was sponsored by the District Employment Exchange, Vellore to the General Manager, TNSTC, Vellore Division vide Lr.No.X2/GB0394/2012, dated 13.09.2012. 4. I have already held that recruitment to the public employment shall not be restricted through Employment Exchange alone and recruitment shall also be made through open market as held by the Honourable Supreme Court in STATE OF ORISSA VS. MAMATA MOHANTY [ 2011 (3) SCC 436 ]. In fact, the said judgment is relied on by the Supreme Court in another judgment in STATE OF BIHAR AND OTHERS VS. CHANDRESHWAR PATHAK [2014 (9) SCALE 239]. 5. In view of the above, a direction is issued to the respondent corporation to issue call letter to the petitioner for the post of Conductor based on the sponsorship along with others. The respondent Corporation shall also call for applications through open market for filling up the vacancies through direct recruitment. The writ petition is disposed of accordingly. No costs.
