JUDGMENT (A.M.Sapre, C.J.) Heard Ms. B. Devi, learned counsel for the petitioners and Ms. U. Dutta, learned counsel for the respondent. This petition has been filed by the Railways who were respondents in Original Application No.228 of 2012. It is filed under Article 227 of the Constitution of India against the order dated 13th September, 2012 passed in O.A. No.228 of 2012 by the Central Administrative Tribunal (hereinafter referred to as ‘the Tribunal’). By the impugned order, the Tribunal allowed the original application filed by the respondent (a railway employee) herein and set aside his transfer order dated 20th July, 2012 whereby he was transferred from Guwahati to Lumding. At the outset, we would like to mention herein that it is not now necessary to examine the legality and correctness of the impugned order of Tribunal in this writ petition because during pendency of this writ petition, certain subsequent events occurred in relation to respondent’s posting (Railway employee) whereby now he was posted as Demonstrator in Signal and Training Centre at Guwahati. So far as this writ petition is concerned, the challenge was made to his transfer order from Guwahati to a place called “Lumding”. We are not now required to examine the legality and correctness of the order impugned in the original application transferring the respondent from Guwahati to Lumding due to respondent’s subsequent posting to a different place. We are, therefore, of the opinion that this petition is rendered infructuous due to aforementioned subsequent events which have a material bearing over the controversy. We, therefore, dismiss this writ petition as infructuous. Before parting with the case, we consider it appropriate to clarify that the observations made by the Tribunal in the impugned order would not come in the way of the Railways to pass any other order relating to posting/transfer of the respondent to any other place in accordance with law and as per policy of transfer and indeed for these observations, the learned counsel appearing for the parties also do not have any grievance. We accordingly record their statement. No cost.
