JUDGMENT Devendra Kumar Upadhyaya, J. The license of a fair price shop of the fourth respondent was cancelled on 9 August 2011 by the S.D.M., Shahabad, District Hardoi. Thereafter, a decision was taken at a meeting of the Gram Panchayat to allot the license of a new fair price shop to the petitioner. According to the petitioner, allotment was made on 27 December 2012. However, in the meantime, the fourth respondent has filed an appeal before the Additional Commissioner, Lucknow Division against the order of cancellation. The S.D.M. has, by his order dated 31 December 2012 (Annexure-1) stayed the proceedings for allotment of the license to the petitioner on the ground of pendency of the appeal filed by the fourth respondent. 2. In this connection, reliance has been placed on an interim order passed by a Division Bench of this Court in Misc. Bench No.11977 of 2010 on 16 September 2011. The issue as to whether the mere pendency of an appeal filed by a person whose license of a fair price shop has been cancelled would operate as a stay on the allotment of the license, has been duly considered in a judgement delivered by this Court on 19 August 2014 in Misc. Bench No. 7649 of 2014 (Vinod Kumar vs. State of U.P. and others). 3. We permit the petitioner to file a representation before the third respondent, namely the SDM, Shahabad, Hardoi together with a copy of the order passed by a Division Bench of this Court in Vinod Kumar (supra). The S.D.M. shall now proceed to act in accordance with the law laid down by this Court in the aforesaid decision. However, we clarify that the S.D.M. shall verify whether any interim order has been passed in the appeal filed by the fourth respondent staying the order of cancellation or whether the appeal has been finally disposed of. The petition is, accordingly, disposed of. There shall be no order as to costs.
