Judgment 1. The petitioner is the first wife of Thiru. D. Rajendran who was an employee of Southern Railway. The husband of the petitioner died on 01.01.2012. The death was after his voluntary retirement from service. The husband of the petitioner appears to have contracted a second marriage during the currency of the first marriage. In the said marriage, he had children. The petitioner approached the first respondent requesting to grant her family pension. The first respondent informed the petitioner that the daughter of the second wife had already obtained a legal heir certificate and on the face of the said certificate, it is not possible to decide the issue. However, on account of the request made by the petitioner, the first respondent referred the matter to the second respondent for filing report after conducting enquiry with regard to the legal heir certificates issued earlier. The present prayer is to direct the second respondent to answer the query raised by the first respondent as early as possible. 2. The second respondent is directed to submit a report with reference to the proceedings of the first respondent in No. U/P. 500/IV/99, dated 07.08.2013. Such exercise shall be completed within a period of three weeks from the date of receipt of a copy of this order. 3. The Writ Petition is disposed of with the above direction. No costs. Consequently, the connected miscellaneous petition is closed.
