Order: 1. The petitioners were appointed as Assistant Salesman on 26.11.2004. Thereafter, they were promoted to the post of Salesman vide proceedings dated 13.01.2006. The promotion order was cancelled by the second respondent on 19.07.2014, without issuing notice to the petitioners. The petitioners are therefore before this Court. 2. There is no dispute that before reverting the petitioners, notices were not issued to them. The reversion of the post would involve civil consequences to the petitioners. As such, they should have been given prior notice. Hence, I am of the view that the impugned orders are liable to be set aside solely on the ground of violation of principles of natural justice. 3. In the result, the impugned orders are set aside and the matter is remitted to the second respondent for fresh consideration. 4. The second respondent is directed to issue notice to the petitioners and thereafter, pass fresh orders on merits. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. 5. In the upshot, I allow the writ petitions. No costs. Consequently, connected M.P.(md).Nos.1 & 1 of 2014 are closed.
