Judgment 1. The petitioner is the second wife of one Thiru. Ganasabapathy, who was an employee of Tamil Nadu Electricity Board. The husband of the petitioner originally married one Gomathy and she died on 18.04.1997. Thereafter, Thiru. Ganagasabapathy married the petitioner in the year 1997 itself. The fifth respondent is stated to be the son born through the first wife. The husband of the petitioner died on 30.10.2008. 2. The petitioner, after the death of her husband submitted an application for family pension. Since there was a dispute, the fifth respondent filed a suit in O.S.No.270 of 2009. The fifth respondent later agreed to make an application for appointment on compassionate ground and permitted the petitioner to receive the family pension. 3. The suit filed by the fifth respondent in O.S.No.270 of 2009 was decreed in terms of memo of compromise on 21.02.2009. The petitioner now wanted the respondents 1 to 4 to consider her claim for family pension. 4. The second respondent is directed to consider the representation submitted by the petitioner for sanction of family pension, in the light of the decree dated 21.02.2009 in O.S.No.270 of 2009 and deed of declaration dated 04.06.2013. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order. 5. The writ petition is disposed of with the above direction. No costs. Consequently, connected M.P. (MD).No.1 of 2014 is closed.
