M. Ilavarasi v. Assistant Director Department of Employment & Training Professional & Executive Employment Branch Office

2014-09-04

K.K.SASIDHARAN

body2014
Order 1. The petitioner belongs to Scheduled Tribe. The petitioner registered her name before the Employment Exchange indicating that she belongs to Scheduled Tribe. The Employment Officer mistakenly noted the community of the petitioner as Scheduled Caste. As a result, her name was not sponsored for appointment to the post of Post Graduate Assistant against the reserved category. Feeling aggrieved by the inaction on the part of the first respondent, to correct the entry regarding the community status and his failure to sponsor the name, the petitioner has come up with this writ petition. 2. I have passed an order dated 14.08.2014, directing the first respondent to produce the Employment Register, in view of the serious allegations made by the petitioner. 3. The Employment Officer is present in Court today. The Employment Officer admitted that the staff who was in charge of making entries in the Employment Register committed a mistake, by showing the petitioner as Scheduled Caste in stead of Scheduled Tribe. The first respondent submitted that the mistake was rectified, after receiving notice from the Court. The first respondent filed an affidavit, which reads thus: “5. I humbly submit that the writ petitioner's name will be sponsored in the category of M.Sc., B.Ed., (P.G.Assistant) Scheduled Tribes (ST), Malayali within a period of one week.” 4. The factual matrix very clearly shows that the Employment Office committed a serious mistake by changing the communal status of the petitioner as Scheduled Caste in stead of Scheduled Tribe. The first respondent rectified the mistake now. The first respondent has also agreed to sponsor the name of the petitioner forthwith. 5. The first respondent is directed to sponsor the name of the petitioner for appointment to the post of Post Graduate Assistant as per his undertaking. Such exercise shall be completed within a period of one week from today. 6. The writ petition is disposed of with the above direction. No costs. Consequently, connected M.P.(md).No.1 of 2014 is closed.
