Judgment 1. The prayer of the petitioner is to direct the respondents to refund the sum of Rs.35,165/-to him on the basis of the proceedings of the fourth respondent in Na.Ka.N1/53689/2009, dated 02.02.2010. 2. The learned counsel appearing on behalf of the petitioner had submitted that the petitioner entered into service in the Tamil Nadu Uniformed Service on 24.06.1968 and retired as Head Constable on 31.12.2004. While he was getting pension, the fourth respondent recovered a sum of Rs.35,165/- from his pension stating that he was paid in excess. Therefore, the petitioner submitted a representation on 01.12.2009 to the fourth respondent for refund of the same. Considering the representation of the petitioner dated 01.12.2009, the fourth respondent vide proceedings dated 02.02.2010 in Na.Ka.N1/53689/2009, communicated that the grievance of the petitioner was under process in the Head Office and upon receipt of the reply from the Head Office, the recovered amount would be refunded to him. According to the petitioner, nothing was proceeded with thereafter. Hence, the petitioner is before this Court. 3. Heard the learned counsel appearing on behalf of the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents. 4. Considering the facts and circumstances of the case, the second respondent is directed to pass appropriate orders on the basis of the proceedings of the fourth respondent in Na.Ka.N1/53689/2009, dated 02.02.2010, within a period of six weeks from the date of receipt of a copy of this order. 5. With the above direction, the Writ Petition is disposed of. No costs.
