JUDGMENT Pradeep Kumar Singh Baghel, J. The appellant had filed a writ petition in respect of his transfer from Mathura to Firozabad in his post as Junior Engineer. The writ petition was dismissed on 14 July 2014 on the ground that the appellant had failed to make out even a prima facie case against the order of transfer. The sole ground, which was pressed, was that the spouse of the appellant is an Assistant Teacher in a School in Mathura. While dismissing the petition, the learned Single Judge observed that this would not preclude the appellant from making a representation. When the appellant submitted a representation, it was rejected on 16 August 2014. The appellant moved a writ Court once again and the writ petition has been dismissed, as not being maintainable by the impugned order of the learned Single Judge dated 9 September 2014. 2. For the purposes of the present special appeal, we may proceed on the basis that the writ petition was maintainable in the sense that it was filed after the rejection of the representation submitted by the appellant following the observations contained in the earlier order of the learned Single Judge dated 14 July 2014. However, be that as it may, it is clear that the appellant is in a transferable service. There was no case of mala fides. Ultimately, it is for the administrative authorities to consider the exigency of service vis-a-vis the personal hardship of the appellant, whose spouse is stated to be working as an Assistant Teacher in Mathura. The rejection of the representation of the appellant cannot be faulted. Hence, for the reasons, which we have indicated, we see no reason to interfere with the order of the learned Single Judge. 3. The special appeal is, accordingly, dismissed. There shall be no order as to costs.
