Judgment S. Manimumar,J. 1. A practising advocate and a sitting Municipal Councilor of Virudhunagar Municipality, has sought for a Writ of Mandamus, directing the Chief Secretary, Secretariat, St. George Fort, Chennai and the Principal Secretary, Department of Co-operation, Food and Consumer Protection, Secretariat, St. George Fort, Chennai, the respondents 1 & 2 to make a fresh fair assessment for family cards, deleting the bogus family cards and issue new family cards to all the eligible families in Tamil Nadu, according to the status, within a stipulated period. He has also sought for a direction to the respondents 1 & 2 to take necessary civil and criminal proceedings against the Civil Supply Officials for issuance of bogus family cards. 2. Instances have been quoted in the supporting affidavit about issuance of bogus cards. Reliance has also been placed on the website details of the Civil Supplies Corporation, as to how ration cards are issued. Attention of this Court was brought to the notice of the Justice D.P.Wadhwa Committee report. However, Mr.A.K.Baskara Pandian, learned Special Government Pleader, who took notice on behalf of the respondents 1 to 3 & 5 to 9, submitted that on the above said averments, the petitioner has not made any representation to the concerned authorities. 3. Indisputably, Public Interest Litigation have come to occupy an important field in the administration of Law and Public interest. Indeed it redresses the grievances of the people. But, in the present case, though the petitioner has asserted that there is a public interest in the matter of distribution of ration cards and regulating supply of essential commodities and further alleged irregularities, yet, this Court is of the humble opinion that the principles applicable for issuance of a Writ of Mandamus, would apply both to the cases of personal interest and public interest. We are not in disagreement with the petitioner on the aspect of public interest. 4. Inasmuch as no representation has been addressed to any of the official respondents herein, much less, to the respondents 1 to 3, bringing to their notice about the irregularities alleged to have been committed by the Civil Supply officials by issuance of bogus family cards, we cannot issue any Mandamus. 5. Unless and until the alleged irregularities are pointed out to the competent authorities, by way of any representation, it cannot be said that they have knowledge of the same.

Question of issuance of Mandamus arises when the official respondents failed to discharge their duties. If the petitioner, a practising advocate, brings it to the notice of the authority concerned, and if there is a failure on their part, then the question of issuance of Mandamus can be adjudicated. As there is no representation, in this regard, we are not inclined to entertain the present Writ of Mandamus. 6. Accordingly, the writ petition is dismissed with liberty to the petitioner to make representation to the concerned authority. Consequently, connected miscellaneous petition is also dismissed. No costs.
