JUDGMENT : Suresh Kait, J. (Oral):-- CM No. 20131/2014 (for restoration) 1. Vide the instant application; the applicant/petitioner seeks recalling the order dated 16.09.2014 whereby the petition was dismissed in default and for non-prosecution. 2. Notice issued. 3. Mr. Hari Kishan, learned counsel accepts notice on behalf of the non-applicant/ respondent. 4. In view of the averments made in the application and the submissions made by the learned counsel, the instant application is allowed. 5. Consequently, the order dated 16.09.2014 is recalled and the petition is restored to its original number. W.P.(C) No. 983/2011 1. Learned counsel for the petitioner submits that the matter has been settled with the respondent/workman for an amount of Rs. 3,50,000/- as full and final settlement. 2. To this effect, a pay order for an amount of Rs. 3 lacs has been handed over and Rs. 50,000/- has been paid in cash to respondent No. 1 (who is present in Court), in the Court today itself. 3. Learned counsel for respondent No. 1, on instruction from the respondent No. 1, submits that the matter has been settled with the petitioner and Rs. 3,50,000/- have been received as full and final settlement. 4. In view of the above, the present petition is disposed of as being settled between the parties.
