Judgment : 1. Petitioner challenges the order of learned Judicial Magistrate I, Poonamallee, passed in M.C.No.7 of 2009 on 06.05.2013. 2. Heard learned counsel for petitioner. 3. On consideration of submissions made and on a perusal of the records, this Court finds reasonable the conclusion of the Court below that the petitioner is employed as a driver. In circumstances where it found no proof of the petitioner's contention regards the wife being engaged as a tailor and earning a sum of Rs.10,000/- per month, the Court below directed payment of monthly maintenance to the first respondent wife and the minor child in sums of Rs.4,000/- and Rs.3,000/-respectively. It is accepted that the petitioner is employed as a driver. Given the attendant facts, this Court is of the view that it would be appropriate, while confirming the liability of the petitioner to effect payment of maintenance, to direct the petitioner to pay monthly maintenance in sums of Rs.3,000/- and Rs.2,000/- to the first respondent wife and the minor child respectively on or before 10th of every month. The maintenance amount now ordered by this Court shall be payable from the date of receipt of this order. In other words, till such date, maintenance shall be paid in keeping with the order of the Court below. 4. This Criminal Revision is disposed of with the above direction. Consequently, connected miscellaneous petition is closed.
