JUDGMENT Mr. Ram Chand Gupta, J. (Oral):- The present petition has been filed for regular bail under Section 439 of Code of Criminal Procedure in FIR no.108/2011 dated 08.12.2011, under Sections 307/427/148/149 IPC and Sections 25/27 of Arms Act, 1959, registered at police station Sadar, District Faridkot. 2. I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Sessions Judge, Faridkot dismissing bail application filed on behalf of the petitioner. 3. It has been contended by learned senior counsel for petitioneraccused that it is a case of version and cross-verion and that dispute was regarding possession over the land and that as per order dated 12.12.2012, Annexure P2, passed by Commissioner, Faridkot Division, Faridkot, it was held that complainant-party is not in possession over the land in dispute. Hence, it is contended that complainant-party was aggressor. It is further contended that he has been continuing in custody since 30.05.2013 and that trial is not likely to be concluded in near future. 4. On the other hand, it has been contended by learned counsel for the complainant that revision against order, Annexure P2, passed by the Commissioner, Faridkot Division, Faridkot has been filed by the complainantparty before Financial Commissioner, Punjab and the same is pending. 5. Bail application has been opposed by learned counsel for respondent-State as well as by learned counsel for complainant on the plea that serious firearm injuries have been attributed to present petitioner-accused. 6. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. 7. Taking into consideration the period of incarceration of petitioner-accused and the fact that it is a case of version and cross-version, without expressing any opinion on merits, the instant application for regular bail filed on behalf of Harbeer Singh @Titu is accepted. 8. Bail to the satisfaction of CJM/Duty Magistrate, Faridkot. ---------0.B.S.0------------
