This writ petition is filed seeking for a mandamus directing the respondents 1 to 4 to remove the unauthorised construction put up by the respondents 5 to 8, measuring about 15 feets in width and 5 feets in height, on the east-west public pathway, comprised in Natham, S.No.317/18, Varadhanallur Village, Bhavani Taluk, Erode District, based on the 1st petitioner's representation dated 31.07.2014. 2. Though notice was served on the respondents 5 to 8 and their names are also printed in the cause list today, they have not chosen to appear either in person or through counsel. 3. It is seen from the papers filed in the typed set of papers that the 1st respondent Collector has already issued some direction to the Tahsildar, Bhavani on the grievance day dated 04.08.2014. Since the petitioner's grievance in this writ petition is that the respondents 5 to 8 have encroached upon the public property and put up some unauthorised construction and as the 1st petitioner has already made a representation on 31.07.2014 to the 3rd respondent, it is for the 3rd respondent to consider the said representation and pass orders on the same, on merits and in accordance with law, after hearing both parties viz., the petitioners as well as the respondents 5 to 8. Such exercise shall be done by the 3rd respondent, within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs. Consequently, connected MP is closed.
