ORDER The petitioner in the present writ application is aggrieved by an order dated 13.3.2001, whereby, the second time bound promotion granted to him vide order dated 18.11.2000 has been cancelled. 2. The petitioner at the relevant point of time was posted as Assistant in Bihar State Co-Operative Land Development Bank, Patna. A plea has been raised on behalf of the respondent-Bank that this writ application should not be entertained on the ground of delay and latches as the petitioner did not challenge the validity of the said order before this Court till he retired with effect from 30.6.2006 after attaining the age of superannuation. 3. Learned Senior counsel appearing on behalf of the petitioner, replying to the preliminary objection has contended that immediately after the impugned order dated 18.11.2000 was passed the petitioner had represented before the concerned authorities but no decision could be communicated to him till the date of his superannuation. 4. A counter affidavit has been filed in the writ application, stating therein that the petitioner was wrongly granted second time bound promotion vide order dated 18.11.2000 without following the required procedure and ignoring the cases of persons who were senior to him. It has further been stated in the counter affidavit that the petitioner will be granted such benefit along with other similarly situated persons whenever the case of the petitioner is considered along with others. 5. In view of the above, I consider it appropriate to dispose of the application in view of the stand of the respondent- Bank taken in paragraph 6 of the counter affidavit that petitioner’s case will be considered along with others for grant of second time bound promotion. 6. This application is disposed of accordingly.
