Judgment M. Jaichandren, J. 1. Heard Mr. R. Anand, the learned Counsel appearing on behalf of the appellant and Mr. R. Karunanithi, the learned Counsel appearing on behalf of the respondent. 2. At this stage of the hearing of the Civil Miscellaneous Appeal, the learned Counsel appearing on behalf of the parties concerned, had placed before this Court the report of the Tamil Nadu Mediation and Conciliation Centre attached the Madurai Bench of the Madras High Court, dated 10.09.2014, stating that the parties to the dispute, had arrived at an amicable settlement and therefore, the Civil Miscellaneous Appeal may be closed in terms of paragraph 6 of the settlement agreement, dated 08.09.2014. 3. Paragraph 6 of the settlement agreement, dated 08.09.2014, reads as follows: "A joint compromise memo signed by the petitioner and respondent in H.M.O.P. No. 297/11, on the file of the Learned Family Court, Madurai on 4/9/14. As a permanent alimony the appellant who is husband, undertake to part with a sum of Rs.22,50,000/- (Rupees Twenty two Lakhs and Fifty thousand only) in three instalments. On 4/9/14, the husband has given Rs.5,00,000/- (Five lakhs only) as Demand Draft (No.363221, Indian Bank, Annanagar branch, Madurai) to wife and the same was acknowledged by her. On 9/9/14 the husband will give Rs.5,00,000/- (Five lakhs only) by way of Demand Draft to his wife before this Hon'ble Court. On completion of rest of requirements prepared by the Learned Family Judge the appellant will settle the balance Rs.12,50,000/- (Twelve Lakhs Fifty thousand only) to the Respondent/wife before the award of decree as prayed in H.M.O.P.No.297/11 on the File of Learned Family Court, Madurai." 4. Recording the settlement agreement, dated 08.09.2014, as noted above, this Civil Miscellaneous Appeal stands closed. The settlement agreement, dated 08.09.2014, shall form part of the judgment. Consequently, the connected miscellaneous petition is also closed. No costs.
