JUDGMENT Pradeep Kumar Singh Baghel, J. The special appeal has arisen from an order of the learned Single Judge dated 13 October 2014, dismissing the writ petition with the following reasons: - "This petition does not disclose any cause of action to the petitioner to recover the personal amount invested by him under some policy. The writ petition is not maintainable and it is accordingly dismissed" 2. From the record, it appears that the appellant had earlier moved a writ proceeding before the Division Bench of this Court which was dismissed as being premature with the clarification that if any adverse action is taken against the appellant, in respect of the period for which she has worked as Headmistress, she would be at liberty to pursue her remedies in law. 3. The appellant has a grievance in respect of the utilisation of funds under the Mid-Day Meal Scheme and it appears from the record that she had submitted a representation to the District Magistrate on 14 June 2014, a copy of which is annexed at Annexure 14 to the writ petition. 4. Without this Court expressing any view on the merits of the grievance, all that we direct is that the appellant may move the District Magistrate afresh together with a certified copy of this order and a fresh representation, upon which the District Magistrate shall consider whether any action is necessary in accordance with law. 5. The appeal is accordingly disposed of. There shall be no order as to costs.
