JUDGMENT Mr. R.P. Nagrath, J. (Oral):- This petition under Section 439 Cr.P.C. has been filed by the petitioner for grant of regular bail in FIR No. 27 dated 17.2.1989 registered under Sections 399/402/148/149 IPC; Section 25 of the Arms Act and Sections 3/4/5 of the TADA Act at Police Station Nakodar, District Jalandhar. 2. The petitioner was declared as proclaimed offender after he jumped the bail during trial. 3. On instructions from ASI Sarabjit Singh, learned State counsel submits that the petitioner was declared proclaimed offender on 20.10.1992. 4. Learned petitioner’s counsel submits that rest of the accused who faced the trial were acquitted by the trial Court vide judgment dated 22.10.1997 (Annexure P-2) passed by the learned Additional Judge, Designated Court, Jalandhar. 5. Petitioner is in custody from 27.9.2013. 6. Without prejudice to the proceedings for forfeiture of the surety bonds, the instant petition is allowed and the petitioner be admitted to bail on furnishing personal bonds with two sureties owning immovable property and to file the documents of immovable property with the trial Court. ---------0.B.S.0------------
