JUDGMENT Mr. Ram Chand Gupta, J. (Oral):- The present petition has been filed for regular bail under Section 439 of Code of Criminal Procedure in FIR no.183 dated 17.07.2013, under Sections 399/402 IPC and Section 25 of Arms Act, 1959, registered at police station Mandi Gobindgarh, District Fatehgarh Sahib. 2. I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Fatehgarh Sahib dismissing bail application filed on behalf of the petitioner. 3. It has been contended by learned counsel for petitioner-accused that alleged recovery effected from present petitioner-accused is only an iron rod and no firearm was recovered from him. It is further contended that he has been continuing in custody since 17.07.2013 and however, trial is not likely to be concluded in near future as no witness has been examined so far. It has also been contended that petitioner-accused is not involved in any other case. 4. This factual position has not been disputed by learned counsel for respondent-State, on instruction from ASI Baldev Singh. 5. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. 6. Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of Pintu Kumar @Pintu is allowed. 7. Bail to the satisfaction of CJM/Duty Magistrate, Fatehgarh Sahib.
