Judgment : 1. When the Second Appeal came up for hearing on 9.9.2014, there was no representation on behalf of the appellant. Therefore, the matter was directed to be listed on 16.9.2014. Even on that day also there was no representation on behalf of the appellant. On the other hand, the learned counsel for the respondent alone was present. Therefore, this second appeal is directed to be listed today under the caption “For Dismissal”. Even today, when the Second Appeal is taken up for hearing, there is no representation for the appellant. Mr. R.G. Narendhiran, learned counsel for the respondent is present. 2. Under this circumstance, this Court presumes that the appellant does not have any interest to get on with the second appeal and therefore, there is no other go for this Court excepting to dismiss the second appeal for non-prosecution. Accordingly, the second appeal is dismissed for non-prosecution with the cost of the respondent. Consequently, connected miscellaneous petition is also dismissed.
