Judgment : 1. The petitioner seeks for issuance of Writ of Mandamus directing the respondent No.2 to cancel the sale deed dated 19.10.2012 executed by one S.L.Siva Kumar in favour of Rathinam Senathipathi vide a Document no- 1671 of 2012 on the file of the Respondent No.3. 2. Heard Mr.S.M.A.Jinnah, learned counsel for the petitioner and Mr.D.Muruganandham, learned Additional Government Pleader appearing for the respondents. 3. It is seen from the counter affidavit filed by the respondents that though the petitioner made a request to the second respondent to cancel the said sale deed by invoking the power under Circular NO.67, since validity of the said circular is pending before this Court, the respondent could not proceed further in the matter. 4. The third respondent further submitted in the counter affidavit that action would be initiated in accordance with the instructions contained in Circular No.67. 5. In the light of the above, there will be a direction to the first respondent to consider the petitioner's objection, in the light of the terms of Circular No.67, after issuing notice to the petitioner and the respondents 4 and 5 and after conducting an enquiry, pass a reasoned order in accordance with law. 6. With the above direction, the writ petition is disposed of.
