Judgment : 1. The petitioner seeks for issuance of writ of mandamus directing the respondent to grant 10 days emergency leave to his son by name Thesingurajan, a life convict (C.P.No.4368) for visiting his ailing mother by considering the representation dated 08.07.2013. 2. The Superintendent of Prisons, Central Prison, Madurai, by way of his proceedings dated 17.07.2013, has stated that the petitioner is not eligible for emergency leave, since Cr.No.950 of 2012 is pending against him. 3. In the light of the above, the writ petition which was filed in the month of July, 2013 could not be kept pending any further, since there would have been change of circumstances, at this point of time. 4. Accordingly, the writ petition is dismissed in the light of the fact that a case was pending against the petitioner. However, this order would not stand in the way of the petitioner to submit fresh representation to be considered on merits. No costs.
