Judgment 1. This civil revision petition has been filed by the plaintiff/decree holder against the docket order dated 25.8.2014 passed in E.P.No.3 of 2014 in O.S.No.253 of 1993 on the file of the District Munsif, Ariyalur. 2. The decree holder filed an Execution Petition in E.P.No.3 of 2014 in O.S.No.253 of 1993 by praying for a direction to the respondent to delivery possession. 3. A perusal of the records would go to show that the said Execution Petition has been consistently adjourned for enquiry. 4. The learned counsel for the revision petitioner has submitted that when the Execution Petition has been filed below two years of passing of the decree, the Executing Court ought not to have issued notice at all to the respondent and should have ordered immediate delivery of possession. Further grievance is that even after the respondent filing counter the Executing Court without proceeding with enquiry is granting indefinite adjournment. 5. A perusal of the records would reveal that counter has been filed on 01.07.2014. On 17.07.2014, 12.08.2014, 25.08.2014 there were adjournments for enquiry. Pointing out these details, the learned counsel for the revision petitioner seeks directions early disposal of the Execution Petition. 6. Considering the aforesaid submission, the Executing Court/District Munsif, Ariyalur is directed to dispose of the Execution Petition No.3 of 2014 within a period of one month from the date of receipt of a copy of this order. 7. With the above said direction the civil revision petition is disposed of. No costs.
