JUDGMENT By the Court.—By way of this petition, the petitioner seeks relief in the nature of injunction that the respondent No. 3, Executive Officer, Nagar Palika Parishad, Etawah shall not dispossess him from the land in question during the pendency of a civil suit in the Court of Civil Judge, (Junior Division), Etawah. 2. To say the very least, there appears no reason that this petition be entertained, where the prayer of the petitioner is essentially for an injunction during the pendency of a civil suit. If at all, such a prayer ought to be made before the trial Court concerned. 3. It is sought to be submitted that the said suit was essentially filed against two private persons and Nagar Palika Parishad was impleaded later, on its application for impleadment. Whatever be the position, it is an admitted fact that Nagar Palika Parishad is a party to the said civil suit. The petitioner is not entitled to take recourse to two parallel set of remedies and that too in the manner that the civil suit remains pending in the trial Court and a prayer for injunction qua the subject-matter of the suit is made in this Court by way of this writ petition. 4. Then, it is submitted that the petitioner has made a representation to the District Magistrate concerned; and the prayer is for directions that appropriate decision be taken on the said representation. 5. We are clearly of the view that even such a representation is entirely misconceived and misplaced, even though it appears that on behalf of the District Magistrate, it has been noted thereupon that appropriate proceedings be taken while keeping in view that the suit is pending in the Court. Nothing further could have been done on the said representation. 6. The petitioner is free to take recourse to appropriate proceedings in accordance with law but no case for grant of any relief in the writ jurisdiction is made out. 7. The writ petition stands dismissed. ——————
