ORDER (Dr. A.K. Rath, J.) Challenge is made to the order dated 7.8.2013 passed by the learned Single Judge in W.P.(C) No.6021 of 2013, whereby and whereunder the learned Single Judge set aside the order dated 4.3.2013 passed by the learned Additional District Magistrate, Dhenkanal in Misc. Appeal Case No.17 of 2010, vide Annexure-3, and directed the Sub-Collector, Dhenkanal and Child Development Project Officer, Dhenkanal Sadar, Dhenkanal to proceed with the selection of Anganwadi Worker in respect of Anganwadi Centre, Madhabaula immediately. Assailing the selection of Anganwadi Worker, respondent no.4 filed an appeal before the Additional District Magistrate, Dhenkanal, which was registered as Misc. Appeal No.17 of 2010. The said appeal was allowed on the ground that the residential certificate of the appellant was not submitted on the last date of submission of the application. As per the guidelines of the Government, the applicant must be the resident of the village/Anganwadi Centre area, where the Anganwadi Centre situates. For the said purpose, the residential certificate of the candidate is required to be filed. Admittedly, the appellant has not filed the residential certificate. Therefore, the Selection Committee was not justified in postponing the selection process for an indefinite period. In view of the same, we do not find any illegality or irregularity in the order passed by the learned Single Judge warranting our interference. The writ appeal being devoid of merit dismissed accordingly. No costs.
