JUDGMENT Mr. Naresh Kumar Sanghi, J.:- Prayer in this petition is for grant of regular bail to petitioner Karamjit Kaur @ Bhuri wife of Harjinder Singh @ Biku, r/o village Rothi Chana, Police Station Bakshiwala, District Patiala, who has been booked for having committed the offence punishable under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985, (for brevity “NDPS Act”) in a case arising out of FIR No.75, dated 14.08.2013, registered at Police Station, Bakshiwala, Patiala. 2. Learned counsel contends that according to prosecution version, two jute bags weighing 52 Kgs of poppy husk was allegedly recovered from the petitioner on 14.08.2013; that the total weight including the weight of the jute bags was 52 Kgs; that the prosecution is not coming up with the net weight of the poppy husk which would certainly be less than 50 Kgs if the weight of the bags is excluded; that if the poppy husk was less than 50 Kgs then it would attract the provisions of non-commercial quantity and the embargo of Section 37 of the NDPS Act would not be applicable for refusal of the bail to the petitioner. 3. Learned counsel for the State, on instructions form ASI Bhag Singh, Police Station, Bakshiwala, Patiala, very fairly concedes that the total weight of the two jute bags containing the poppy husk was 52 Kgs and it would be a moot point during the course of trial regarding the net weight of the poppy husk recovered from the petitioner. He further concedes that the petitioner is behind the bars from 14.08.2013 and she is neither required nor involved in any other case. 4. Heard. 5. In view of the rival contentions noted hereinabove, the present petition is allowed. The petitioner, who is a woman, is ordered to be released on bail, during the pendency of trial of the present case, subject to her furnishing bail bonds to the satisfaction of the learned trial court. ---------0.B.S.0------------
