Judgment 1. The defendants 1, 4 and 5 are the revision petitioners. 2. The revision petitioners filed I.A.No.2119 of 2007, seeking for appointment of an Advocate Commissioner for the purpose of working out the terms of the preliminary decree, to inspect the suit properties, note down the physical features, suggest means of division and also to file a report and plan. 3. A perusal of the Docket entries of the Court below would go to show that the Commissioner has filed his report and plan on 10.12.2013 itself. For the past six months, the case is adjourned only for the purpose of filing objections to the Commissioner's report. A perusal of the docket entries would also go to show that till 05.06.2014, the objection to Commissioner report is not filed and the Court below has simply adjourned the matter only for the purpose of receiving objections. 3.1. Once, the Commissioner's report is filed, that too in the final decree application the Court below ought not to have adjourned the matter for six months for the aforesaid reasons. 4. In view of the same, the Court below is directed to dispose of the I.A.No.2119/2007 in O.S.No.459/1999, within a period of one month from the date of receipt of a copy of this order. 5. With the above directions, this Civil Revision Petition is disposed of. No costs.
