JUDGMENT Mahendra Dayal, J. Heard learned counsel for the parties. 2. This writ petition has been filed on behalf of the petitioner assailing the order dated 18.07.2014 passed by the learned District Judge, Lucknow, whereby the learned District Judge, while passing an order on the application for interim relief, has fixed the case for hearing of the appeal. 3. Learned counsel for the appellant submits that since the appeal has been admitted for hearing, it would be in the interest of justice, that the eviction of the petitioner be stayed till the final disposal of the appeal, but the learned District Judge has not passed any order staying the eviction of the petitioner. 4. Learned counsel for the contesting respondents no.2 and 3 has submitted that the appeal is ready for arguments, but the petitioner is not willing to argue the appeal and wants to prolong the matter so that he may not be evicted. 5. Having heard learned counsel for the parties and considering the circumstances of the case, the writ petition is disposed of with a direction that the appellate court shall decide the Rent Appeal No.47/2014 within a period of three months, from the date of receipt of a certified copy of this order. It is further provided that the petitioner-appellant shall not seek any unnecessary adjournment before the court below. 6. With the aforesaid direction, the writ petition is finally disposed of.
