Judgment Sudhanshu Dhulia, J. (Oral) In compliance of this Court’s order dated 04.09.2014, Investigation Officer of this case Mr. G.S. Samant, Inspector is present before this Court. He explains that though the Viscera Report has come but nothing has come in the Viscera Report and the report is negative. In view thereof, personal presence of Investigating Officer is exempted. Heard Mr. Sandeep Kothari, Advocate for the applicant, Mr. P.S. Saun, learned Deputy Advocate General for the State of Uttarakhand. The applicant is in jail having been implicated in Case Crime No.06 of 2014, which has been registered under Sections 302/201 of I.P.C. Police Station – Muni Ki Reti, District-Tehri Garhwal. According to the complainant his six years old son went in a marriage and thereafter he was found missing in the night of 18.04.2014. His body was recovered the next day and some parts of the body were eaten by some animals. Viscera report does not disclose anything as to the cause of death. The only evidence against the applicant is the statement of the elder sister of the deceased who is about 9 years who had seen three applicants along with her brother on the fateful night in the marriage ceremony. According to the statement of the complainant he does not have any enmity with anyone. Applicants are students who are about 21 years of age. Considering the overall evidence which is presently available before this Court, the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicants (Bhagwan Singh Rana, Hikammat Singh and Dinesh Singh Panwar) be enlarged on bail in the aforesaid crime on their executing a personal bond each and two reliable sureties each of the equal amount to the satisfaction of the Magistrate concerned. It is made clear that in future if any further evidence comes out against the applicants or they misuse the bail, the State would always be at liberty to approach this Court for cancellation of their bail. It is also made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings.
