Judgment Sudhanshu Dhulia, J. (Oral) In compliance of this Court’s order dated 29.08.2014, Investigation Officer of this case Mr. Shresth Gunsola, Nayab Tehsildar, Tehsil-Thailisain, District Pauri Garhwal is present before this Court. The reason he assigns for non availability of the Viscera Report is that since the death of the victim occurred in Ghaziabad, therefore, the Viscera was sent for examination to Forensic Science Laboratory, Agra where it will take some time. In view thereof, personal presence of Investigating Officer is exempted. Heard Mr. D.C.S. Rawat, Advocate for the applicant, Mr. B.M. Pingal, learned Brief Holder for the State of Uttarakhand and Mr. Anil Dabral for the complainant. The applicant is in jail having been implicated in F.I.R./ Crime No.01 of 2014, which has been registered under Sections 498-A/284/304-B of I.P.C. Police Station Patti Patwari Circle - Khatali Palli-5, Tehsil - Thailisain, District-Pauri Garhwal. According to the applicant he is a student and on the fateful day he was not in the village and he was in Srinagar, Garhwal in connection with the Ph.D. thesis which he is pursuing in H.N.B. Garhwal University, Srinagar. The victim consumed poison in the village on 13.04.2014. She was taken to Ramnagar and then to Kashipur and ultimately to Ghaziabad where she died on 22nd April, 2014. In this case the viscera report has not been received as yet. The Investigating Officer of this case i.e. Nayab Tehsildar Tehsil-Thailisain, District Pauri Garhwal was called in the Court who is present before this Court, who gave a statement that Viscera was sent for examination to Forensic Science Laboratory, Agra and the report is still awaited. Considering the overall evidence which is presently available before this Court, the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicant (Ashok Nautiyal) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Magistrate concerned. It is made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings.
