Judgment 1. This revision petition has been filed challenging the order of attachment/reattachment made by the Executing Court in R.E.P.No.106 of 2009 in L.A.O.P.No.14 of 1992. 2. According to the learned counsel for the revision petitioner, the balance of compensation payable on account of the land acquisition has been subsequently deposited before the Executing Court itself, and therefore, the order of attachment cannot be allowed to continue. 3. Having regard to the submissions made, the revision petitioner is at liberty to file petition before the Executing Court seeking the relief of raising the attachment, on the ground that the balance amount of compensation has been already paid. Only when such a step is taken, the other side will be in a position to say, as to whether the entire amount of compensation has been deposited or not. 4. When petition seeking raising of attachment is filed, the Executing Court is directed to consider the petition and after hearing both sides, to decide the matter on merits and to pass appropriate orders. With the above observation and direction, this Civil Revision Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
