Judgment : Mr. V.B. Thirupathikumar, learned counsel for the petitioners in M.P.No.1 of 2014, filed for condoning the delay of 855 days in representing the Second Appeal, has submitted that the dispute involved in the Second Appeal has been settled out of Court. He further submitted that as the Second Appeal has not yet been numbered, he requested to return the Court Fee and sought to withdraw the Second Appeal. He has also made an endorsement to that effect. Recording the submission and endorsement made by the learned counsel for the appellants, M.P.No.1 of 2014 and the Second Appeal are dismissed as withdrawn. Since the Second Appeal is only in the SR Stage, the Registry is directed to refund the Court Fee. However, there is no order as to costs.
