JUDGMENT Pradeep Kumar Singh Baghel, J. The relief which has been sought in these proceedings is as follows: (A) To issue a writ or direction or order in the nature of mandamus commanding the respondent No. 1 to 5 to constitute a committee headed by District Magistrate, Bareilly for inquiring into illegal encroachments and illegal occupation by respondent No. 6 over Public Wells Size 18 x 35 Feet and Hand Pump situated on Gaon Sabha Arazi of 150 Yard situated in the Village Vahanpur, Tehsil Faridpur of District Bareilly. (B) Issue a writ, order or direction in the nature of mandamus commanding respondents to get the land vacated from such illegal encroachments if made on Public Well and Public Hand Pump situated on Gaon Sabha land in Village Vahanpur of Tehsil Faridpur in the District Bareilly.? Having due regard to the allegation that there is an illegal encroachment over a public Well, we direct the Sub Divisional Magistrate, Faridpur District Bareilly to take cognizance of the grievance and after due inquiry into the matter, no later than within two weeks from today, take such necessary steps as are required in law, in the event that the grievance is found to be genuine. We expressly clarify that we have not made any finding on the merits of the allegation and any action shall be taken in accordance with due process of law after hearing all the affected parties. The petition is, accordingly, disposed of. There shall be no order as to costs.
