JUDGMENT Pradeep Kumar Singh Baghel, J. The grievance in these proceedings which have been instituted in the public interest is in respect of brick kilns which have been operated by the fifth and sixth respondents. According to the petitioner, the brick kilns are being conducted in violation of the Uttar Pradesh Brick Kilns (Site Criteria to Establishment) Rules, 2012. 2. In this regard, the petitioner has drawn attention to the fact that on 12 November 2014, an inspection was carried out by the Technical Assistant and the Regional Officer of the U.P. Pollution Control Board. It has been stated that despite notices which were issued by the Board, no action has been taken. 3. In such matters, it is not necessary for the Board to compel an individual citizen to move the Court with proceedings under Article 226 of the Constitution for invoking its statutory powers and performing statutory obligations under legislation such as the Air (Prevention and Control of Pollution) Act 1981. The Board is a statutory body and is duty bound to enforce the provisions of law. The Regional Officers of the Board however seem to be oblivious of their duty to perform their statutory obligations. 4. In the absence of the private respondents, in the present case, we have not expressed any finding on the merits of the grievance. However, we direct the second respondent to specifically issue instructions for carrying out a proper inspection with due notice to the fifth and sixth respondents. The second respondent shall personally monitor the entire process. Thereafter, if it is found that there has been any violation of law, necessary action shall be taken to ensure compliance with law. The writ petition is, accordingly, disposed of. There shall be no order as to costs.
