Judgment 1. This Writ Petition has been filed by the petitioner for issuance of a Writ of Mandamus, directing the respondent to grant permission and protection for Arulmigu Sree Therukku Mariamman Kovil at Rayagiri Village, Sivagiri Taluk, Tirunelveli District on 05.10.2014 and for the "Aadal Paadal Dance" programme on the night of 05.10.2014. 2. By consent, the Writ Petition itself is taken up for final disposal. 3. Mr.N.S.Karthikeyan, learned Additional Government Pleader takes notice for the respondents. 4. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents. 5. In the affidavit, it has been stated that every year, the villagers used to celebrate festival in Arulmigu Sree Therukku Mariamman Kovil at Rayagiri Village, Sivagiri Taluk, Tirunelveli District in the Tamil Month of Puratasi and devotees from various parts of the State used to visit the temple and offer their prayers. In this year also, the villagers have decided to celebrate the said festival on 05.10.2014. In this regard the petitioner has sent a representation, dated 22.09.2014 to the respondent seeking permission to conduct the "Aadal Padal Dance" programme. But the said representation has not been considered so far. Hence the petitioner has come forward with this Writ Petition for the relief stated supra. 6. Today when the matter is taken up for hearing, the learned Additional Government Pleader submitted that on an earlier occasion, this Court by accepting the submission of the learned Additional Government Pleader, imposed 23 conditions to conduct Adal Padal programme and if the same conditions are imposed the respondents will consider the application of the petitioner. The condition imposed by this Court on an earlier writ petition is as follows: “TAMIL” 7. The learned counsel appearing on behalf of the petitioner submits that he would abide by all the above said 23 conditions, which are enumerated by the respondent Police. 8. In view of the above, this Writ Petition stands allowed and the respondent Police is directed to give necessary permission by imposing the above said conditions for conducting the Aadal Paadal Dance Programme on 05.10.2014 by considering the representation of the Petitioner, dated 29.09.2014. No costs.
