Judgment 1. No representation on either side. However, upon perusal of the materials available on record, this Court proceeds to pass orders on merits. 2. This writ petition has been filed by one Mrs. S. Amutha, claiming to be the wife of the deceased late Kannappa Raja, challenging the dismissal order imposed against her husband on 12.12.2005, on the ground that punishment of dismissal imposed against her husband is reflection of non-application of mind on the part of the first respondent. 3. This Court is unable to find any merit or substance in the writ petition. 4. The reasons are two fold: 5.(i) Firstly, the petitioner's husband late Kannappa Raja, who was dismissed from service by the first respondent in a proceedings in Se.Mu.Na.Ka.No.2541/05/Aa1, dated 12.12.2005 has been accepted by her husband without making any challenge to that, since he died only on 15.03.2007. (ii) Secondly, the petitioner being the wife of late Kannappa Raja cannot challenge the dismissal order dated 12.12.2005 with inordinate delay of nine years. As there is no explanation or sufficient cause for condoning the delay of nine long years, this Court finds that the petitioner is guilty of laches. 6. In view of the above, this Court does not find any merit in the writ petition. Hence, the same is dismissed. Consequently, connected miscellaneous petition M.P.(MD).No.1 of 2014 is also dismissed. There shall be no order as to costs.
