Mr. Naresh Kumar Sanghi, J.: - Prayer in this petition is for grant of regular bail to petitioner Jaswinder Singh who has been booked for having committed the offences punishable under Sections 15 and 27-A of the Narcotic Drugs and Psychotropic Substances Act, 1985, (for brevity “NDPS Act”) in a case arising out of FIR No.572, dated 17.10.2013, registered at Police Station, Sadar, Fatehabad. 2. Learned counsel contends that the petitioner is behind the bars from 17.10.2013; that non-commercial quantity of 36 Kgs and 400 grams of the poppy husk was allegedly recovered from the petitioner; that trial would take sufficient long time to conclude; and that the petitioner is neither required nor involved in any other case. 3. Learned counsel for the State, on instructions from ASI Satish Kumar, Police Station, Sadar, Fatehabad, submits that seven witnesses have already been examined. However, he fairly concedes that the poppy husk allegedly recovered from the petitioner was of non-commercial quantity and the petitioner is neither required nor involved in any other case. 4. Heard. 5. In view of the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Jaswinder Singh, s/o Bant Singh, r/o near Nirankari Bhawan Shimlapure Colony Ratia, Tehsil Ratia, District Fatehabad, is ordered to be released on bail, during the pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the learned trial court.
