JUDGMENT S. VIMALA, J. 1. This petition for transfer is filed by the wife seeking transfer of H.M.O.P. No. 38 of 2014 from the file of the Sub Court, Sangakiri to the file of the Family Court, Trichy. 2. Despite notice, the respondent did not appear and contest the proceedings and the name of the respondent has also been printed in the cause list. 3. The petition in H.M.O.P. No. 38 of 2014 has been filed by the husband seeking the relief of restitution of conjugal rights. 4. The wife seeks transfer on the following grounds:- (i) The distance between Sangakiri and Trichy is 250 Kilometers. (ii) The travel expenses would come to Rs. 800/- when she has to take an attendant along with her. (iii) She has no independent source of livelihood and depending upon her aged parents for the day-to-day living expenses. On all the above grounds, the petitioner plead that the transfer petition has to be ordered. 5. Considering the circumstances stated above, this Transfer Civil Miscellaneous Petition is allowed and accordingly, H.M.O.P. No. 38 of 2014 is ordered to be transferred from the file of the Sub Court, Sangakiri to the file of the Family Court, Trichy. Consequently, the connected miscellaneous petition is closed. No costs.
