Judgment 1. This criminal original petition is filed, seeking to modify the condition imposed in C.M.P.No.2653 of 2014 dated 24.09.2014 by the learned Judicial Magistrate No.IV, Vellore regarding execution of the sureties. 2. The petitioner was granted regular bail by the learned Judicial Magistrate No.IV, Vellore on 24.09.2014 in which one of the conditions was imposed to the effect that the petitioner shall execute a bond for Rs.5,000/- for himself along with two sureties for a likesum each and one such sureties shall be his close blood relative. 3. It is submitted by the learned counsel for the petitioner that no close relative is coming forward to stand as surety to the petitioner. The petitioner has been in jail since 24.08.2014 and even after obtaining bail order on 24.09.2014, the petitioner is unable to come out on bail on account of non execution of surety. 4. In such circumstances, I am inclined to modify the 1st condition imposed by the learned Judicial Magistrate No.IV, Vellore as under: “The petitioner shall execute a bond for Rs.5,000/- with two solvent local sureties each for a like sum to the satisfaction of the learned Magistrate concerned.” Other conditions imposed shall remain unaltered. 5. The petition is ordered accordingly.
