Judgment : 1. Heard Mr.A.Saravanan, the Learned Counsel appearing for the Petitioner and Mr.Rajarajan, the Learned Government Advocate appearing for the Respondents. 2. According to the Petitioner, even though the land in question is an extent of 1 Acre and 56 Cents (0.63.0 Ares), but presently, the area in question has been reduced to some extent and on 28.08.2014, he sent his representation, requesting the Respondents to carry out survey and demarcate the boundaries of the land in question. Added further, necessary fees for conducting survey was also remitted by him on 28.08.2014. Till date, the Respondents has not carried out the survey of the land in question. As such, the petitioner was constrained to file the present Writ of Mandamus and to seek appropriate remedy in the manner known to law and in accordance with law. 3. In view of the fact that the Petitioner had made a representation dated 28.08.2014, addressed to the 1st Respondent / the Tahsildar, Marungapuri Taluk, Trichy District, seeking survey of the land in question, this Court, without going into the merits of the matter and also not expressing any opinion one way or other and also not delving deep into the matter, at this stage, in the interest of justice and Fair Play, directs the Respondents to consider the representation of the Petitioner, dated 28.08.2014 in a Just, Fair and Equitable manner and to dispose of the same on merits, of course, after affording necessary opportunities to the Petitioner and others concerned, if any, by adhering to the principles of natural justice, within a period of six weeks from the date of receipt of a copy of this order. 4. It is open to the Petitioner to produce / hand over the xerox copies of the documents to the Respondents, in case they are in need of the same. If the Respondents feel that the documents to be produced or to be handed over by the Petitioner are useful and will have a bearing in regard to the survey of the land in question, then it may be taken into an account by them in a Fair and Dispassionate manner and the respondents are directed to do the needful in the matter in issue, as expeditiously as possible, in any event, within a time limit prescribed by this Court, as stated supra. 5. With the aforesaid directions, the Writ Petition stands disposed of.
